1. Overview
Welcome to Homecrafts Preserves (“we”, “us”, “our”). We operate this online store and website to provide our customers in the United Kingdom with access to our handmade food products, including preserves, jams, chutneys, and related goods (“Products”).
These Terms of Service (“Terms”) govern your use of our website and your purchase of our Products. Please read them carefully. By accessing our website or placing an order, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree with these Terms or our Privacy Policy, you should not use our website or purchase our Products.
2. Eligibility and Accounts
You must be at least 18 years old to make a purchase. You agree to provide accurate, current and complete information when creating an account or making a purchase.
You are responsible for maintaining the confidentiality of your account details and for all activity under your account. If you suspect unauthorised access to your account, please contact us immediately.
3. Our Products
All our Products are made and sold in compliance with UK food safety and labelling regulations, including the Food Information Regulations 2014 and relevant Food Safety Act 1990 requirements.
We take care to display our Products and descriptions accurately. However, the images on our site are for illustrative purposes only, and packaging or presentation may vary slightly.
Allergen information:
Ingredients and allergens are clearly listed on each product label. It is your responsibility to check this information before consuming the product. If you have any allergy or dietary concern, please contact us before purchasing.
We reserve the right to modify, discontinue, or limit the availability of any Product at any time.
4. Orders and Contract Formation
Your order constitutes an offer to purchase. A legally binding contract is formed only once we send you an email confirming acceptance of your order and dispatch of your goods.
If we are unable to fulfil your order, we will notify you and refund any payment made. We reserve the right to refuse an order if, for example, the product is out of stock, there is an error in the price or description, or we reasonably believe the order to be fraudulent.
5. Prices and Payment
All prices are in Pounds Sterling (£) and include VAT (where applicable). Delivery charges are displayed separately at checkout.
We accept payment through secure third-party payment providers (Shopify Payments, PayPal, or others). Payment must be made in full at the time of order.
We take reasonable care to ensure that prices are correct at the time of publication. If we discover an error, we will inform you before dispatch and give you the option to confirm your order at the correct price or cancel it.
6. Delivery
We deliver only within the United Kingdom (excluding NI). Estimated delivery times are provided during checkout, but are not guaranteed.
We are not responsible for delays caused by circumstances outside our reasonable control (e.g. postal strikes, weather, or courier issues).
Risk in the Products passes to you once they are delivered. Legal ownership of the Products passes to you only once full payment has been received.
7. Returns, Refunds, and Cancellations
Perishable Goods (Food Items)
Under the Consumer Contracts Regulations 2013, the usual 14-day cooling-off period does not apply to perishable goods such as food items. For this reason, we cannot accept returns or offer refunds for food products unless they are damaged, faulty, or incorrect.
If your order arrives damaged or incorrect, please contact us within 7 days of delivery at sales@homecrafts-preserves.com, providing your order number and photos of the issue. We will arrange a replacement or refund.
Non-Perishable Goods
If you purchase any non-food items (e.g. gift boxes, utensils, merchandise), you may cancel your order within 14 days of receipt and return the goods in their original condition for a refund. You are responsible for return postage costs.
8. Product Safety
We comply with all applicable UK food hygiene and labelling standards. You agree to store our Products in accordance with the instructions on the packaging and to observe any best-before dates. We accept no liability for deterioration or harm caused by improper storage or handling after delivery.
9. Intellectual Property
All text, images, branding, and content on our website are owned by Homecrafts Preserves. You may not reproduce or use any of our materials without prior written permission.
10. Third-Party Services
Our website is hosted by Shopify, which provides the online e-commerce platform that allows us to sell our Products to you. Your use of the website may involve third-party tools or links; we are not responsible for the content, accuracy, or actions of any third-party sites.
11. Privacy
Your personal data will be handled in accordance with our Privacy Policy and with applicable UK data protection laws, including the UK GDPR and the Data Protection Act 2018. 12. Limitation of Liability
Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under UK law.
Subject to the above, we shall not be liable for any indirect, incidental, or consequential losses, including loss of profits, arising out of your use of our website or purchase of our Products.
Your statutory rights as a consumer are not affected.
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to These Terms
We may update these Terms from time to time to reflect legal, operational or business changes. The latest version will always be available on our website, and material changes will be notified to you before taking effect.
